17/10/08 HOLROYD RESIDENT FINED FOR ILLEGAL LOPPING OF TREE
A resident of Fairfield Road, Woodpark was convicted of two offences of illegal lopping works of his neighbour’s Jacaranda tree, in Parramatta Local Court recently. Council took the resident to Court following the illegal lopping works in November and December 2007. The mature Jacaranda tree located at a property in Fairfield Road is one of the largest known Jacaranda trees in Holroyd with a canopy span of approximately 18 metres and 16 metres high with an estimated age of 60 – 70 years old.
The illegal lopping resulted in the removal of one of the tree’s three main trunks resulting in nearly one third of the tree being removed. The resident’s reasons for lopping the tree included safety reasons because of overhanging branches and the build up of leaves and twigs in the house gutters and minor damage to the house. He also indicated he had no knowledge of Council’s Tree Management Order. The Court dismissed these reasons.

Local Property Manager Fined $15,000 for Illegal Tree Pruning |

A property management professional was fined last month (February) in Parramatta Local Court for authorising illegal pruning works to 5 Eucalyptus trees in Oxford Street Merrylands.
A local strata agent was fined $15,000 and ordered to pay Council’s costs of $4,500.
Magistrate Denes indicated the defendant (as a property management professional/strata manager) wilfully breached Council’s Tree Management Order and together with the lasting harm that was suffered to the native trees, had contributed to the seriousness of the offence. In addition, the trees were located on the neighbouring property.

Byron Shire Resident Convicted For Tree Removal |

On Thursday 16 August 2007 in the Mullumbimby Local Court a Byron Shire resident was found guilty for the removal of ten Tallow Wood trees on a rural property located at Tyagarah.
The man was convicted for the criminal offence of development without consent and fined $7,500. He was also ordered to rehabilitate the site at a cost of $2000 and pay Council’s legal costs of $660.
It was revealed in court that the trees were most likely cut down for the purpose of improving the view of the dwelling that the man was residing in at the time. During sentencing, Local Court Magistrate Jeff Linden indicated that this type of offence is a serious matter and such matters will be dealt with accordingly.

6 February 2004 Tree Preservation Order Fines Highlight Need for Awareness
A local company has been fined $1,200 following a breach of Coffs Harbour City Council's Tree Preservation Order (TPO).
Council initiated court action to enforce its TPO following the removal of koala habitat trees on a Moonee property in June last year.
Director of Council's Planning, Environment and Development Department, Gina Vereker said the incident highlighted the need for all landowners and occupiers to be aware of the Coffs Harbour Tree Preservation Order.
"Anyone considering cutting or lopping trees anywhere in the Coffs Harbour Local Government Area should first consult council and obtain the proper approval if it is required," Ms Vereker said.
