6 February 2004 Tree Preservation Order Fines Highlight Need for Awareness A local company has been fined $1,200 following a breach of Coffs Harbour City Council's Tree Preservation Order (TPO). Council initiated court action to enforce its TPO following the removal of koala habitat trees on a Moonee property in June last year. Director of Council's Planning, Environment and Development Department, Gina Vereker said the incident highlighted the need for all landowners and occupiers to be aware of the Coffs Harbour Tree Preservation Order. "Anyone considering cutting or lopping trees anywhere in the Coffs Harbour Local Government Area should first consult council and obtain the proper approval if it is required," Ms Vereker said. "Council takes breaches of the TPO and other environmental and planning controls very seriously. "Ignorance is no excuse and will not stand up in court. "It is far better to check first, especially considering the fines can range from $600 on the spot up to $1.1 million in the Land and Environment Court." A spokesperson from Matcove Pty Ltd said "it was certainly better to be safe than sorry." "People should check first with Council about cutting down trees to avoid the position we found ourselves in." "Like us, you might not think you are doing anything wrong, especially if you don't have much experience in this type of thing. Council can set you right before you start."
